Doubtful @ I-140 portability? Let's do this..

Folks,

I have already called up two times and got responses from CIS IO.
Am I the only one eager to know about the I-140 portability, etc., :confused: , I hope not!

Please spare 15-20 min and make that call to CIS (Tip: You can keep surfing this portal while on the phone call, so your time is not wasted anyway!).

Even though a lot of people would like to call and get some answers, not everybody can get thru the IO ( not the CSR- first line I don't know- am just following rules person) as the ND has not crossed the current Process Date. Pls let us know how did u manage to get thru, if the same situation holds for u.

***that has nothing to do when you call for a general enquiry, stating that you need some clarification on AC21 law.

Pls let us know how did u manage to get thru, if the same situation holds for u.

***very simple, the CSR may not be able to answer your queries, just request them to Xfer you to IO and they will do it for you....isn't that easy :p

Call USIC NSC and they said YES

I called NSC and they confirmed two things and I dont know what else to do to believe it..and to convince my Lawyer. I had scheduled an appointment with him to meet personally and would post my discussion with him on this forum.
1) You can change your job once I-140 is pending for more than 6 months, a job of similar nature.
2) You need to send job title, job description and employement letter of change.
3) There shouldn't issue any RFE based on previous employer.

This is something she did tell me by her own, she read from guided instruction and I could feel that she is reading and answering my question. The questions is why they just issue a memo??? Anyway I'm working on it to get more and more clarifications....Lets work together to dig more details and confirmation.

One question. You talked to NSC=>Nebaraska Service Center Or NCSC => National Customer Support Center? Kindly clarify.

I also read in muthy forum few months back, that somebody called NCSC and the IIO told him very clearly that "You can change job after 180 days of I-485 pending and I-140 status does not matter amy more". I will try to find out the link.

I dont mean to bring you down. I would be the first person to rejoice if this were true. But how does it matter until this becomes official. As long as it is not blessed into a law, cis can play any game it wants to.

USICS is not logical in anyway so one should do what makes his/her case stronger.

By the way I had already changed the job and is on H-1B of new company. I have least chances to get I-140 approved filed from previous company and if this is all true, chance of my case improves to 90%.

We may agree that USCIS stand on AC-21 rule to process I-140 is changed but officials, like lawyers and company's immigration specialist are doubtful and I dont know what to do to convince them without a official memo from USCIS. Any suggestions are most welcome.....

Why you need an official memo, when the AC21 law itself does not say that I-140 approval is needed? And do you think all these Officers are just guessing and telling without having a regulation or internal memo from USCIS?

Just my thoughts.

it's not legal

just so you know, it is not Legal to record conversation with someone w/o their consent. you might get in trouble.

Actually a better idea would be to note down the name of the person and time.Atleat that way we can say that this was confirmed by so and so ...

All of these people have this stand that you can't change your job if your I-140 is not approved even though this is not stated in AC-21 rule itseld for this is the way it's implied. This is what all officials says.

If it was so easy to get past the first line CSR to IIO, then I would have got GC by now! Not only me, but everybody. Basically I am metaphorizing that it doe snot happen. I have called 3 times and I ahve been read the forking text from the website, as if I am an illiterate idiot not able to read. And since the 140 is an employer petition, they r not allowed to transfer our calls to the IIO unless the ND has crossed the blah blah blah....
SO PLS TELL ME WHAT DID U SAY TO GET PAST THE AOVE HURDLES!
 
well all conversations are recorded as they say, right, so well note down the time and date of conversation and the official you spoke to, doesnt that sound legit.
 
By the way I got the reply from my Lawyer

This is what he says. This is the Lawyer whom I paid from my pcoket he is not the company;s Lawyer...

"Without I-140 approval u cant change the employer under AC21 ie after 6
months. I have no comments on discussion boards."

This is it, end of the chapter....We can't use AC21 till we get a written confirmation from USCIS, but one can use it to it's discretion.
 
Amen !!.

I have been watching this thread. My take on this issue is that - USCIS might be working on such a memo. So until it is released on their website, just be patient.

There is no meaning in calling the NSC or NCSC and bugging them.
