Any ideas?
I am faced with a real challenging situation. I have been working in US for last 8 years. First 5 years as a TN holder. Then a lawyer suggested H1B as a better option, which seemed like a good idea at first. I was granted H1B and the first 3 year period will expire in two months. In the meantime, my attorney applied on my behalf for Green card. I sucessfully went through Labor Certification. Now USCIS is asking for copies of my W2s which I don't have! I have been working on 1099 all these years. Now she found out and was surprised! Somehow, this never came up, she never told me about the details and never asked me about W2s. I never researched this on my own, trusting her knowledge and expertise.
Now I have 2 major issues. Do I let her extend my H1B visa (she still claims it will be just a formality?!!!!). Switch back to TN? How do I explain to USCIS the fact that I have H1B and not W2? Come forward and tell them that there was lack of communication between my lawyer and I about this matter? And what do I do about my application for Green Card? Withdraw it? Maybe switch my lawyer? Please, any kind of help would be great. I am really confused about what to do.
