Doing Business on H-1B with a company in India

All,

I am on H-1B visa right now and have registered a DBA tradename in USA. I know I cannot work for the company. Now I have a Indian Company ready to invest and do business on this name. Is it going to hinder my present legal status. The company is ready to invest 400k into my registered company. Now I need to know
1. Can I be a passive partner of the business with all of the work done at offshore in bangalore -india.
2. Now can I get money into my business accounts and do I have to pay taxes on all of the amounts I get into it
3. Is this going to affect my present green card process??
4. Can anyone suggest me a good lawyer I can hire for all this in Connecticut Area.

Any information on the above following will be of great help to me, since I am interested to do enterprenurial business in this land of opportunities.

I had these kind of discussions with my lawyer last year about alternatives ways to get GC. According to him you can start business and become partner in company and if you file GC under EB5 and get GC within 5-6 months. This also subject to investing @500K in company and hiring atleast 10 US citizens.

But i have generic question, that if some one brings capital from india, does that will be subjected to double tax? meaning i have already paid legal tax on capital and need to bring in US...

Quick Info - Need specifics

Thanks for the reply. But I need specific information for the following:

1. Right now I am working for a employer and earning money for 40 hrs per week. I have a registered DBA company. Do I have to pay taxes on this company I register if I don't get any money
2. Now in what way can this new registered DBA(Doing Business As) company affect my Green Card sponsored by my employer??
3. Just in case if it creates problems can I transfer this company to a purchaser in India who is ready to invest 400k on this fictious company registered in USA.

Please reply back to these, cause I need to get it clear before I proceed ahead. thanks
 
Guyz general info from my lawyer

I did speak to my employers lawyer in CT. He says I cannot get any income on my name for this company. The company that I have registered as DBA can hire only GC or U.S citizens. I can get money to this company from an external source showing as investment. But I cannot work or claim any money on my name which is illegal.

All I can say is don't do anything. This freaking assholes are very very clever. They try to corner you one way or the other way. If the accounts are not maintained then you are screwed. Land up paying double the money in taxes. Overall work, pay taxes and relax back. I am sending back the money what I got as investment and closing the company off. Without generating a single pie I am getting letters from internal revenue office. Local offices know nothin about this formalities that INS does. Overall finally in GC processing its screwed. B careful :(
