06/16/2007: Status of Employment-Based Nonimmigrants Pending Extension Petition Beyond 240 Days for Security Check Delays
* The USCIS authories confirmed that the alien is not authorized to stay and work beyond 240 days of expiration of the current I-94 pending the extension petition. Reportedly, there are a number of cases of extension petitions which have been stuck beyond 240 days from the expiration of current I-94. Obviously the USCIS may exercise discretion not pursuing such violation. The opinion of the USCIS HQ official is indeed troublesome in that strictly speaking such alien can be pursued by the USICE for the immigration enforcement.
