does the regrogression apply to the people who have already submitted 485??

I just spoke with my company lawyers and she said it will affect me.
My 140 is approved and 485 is pending (name check cleared recently).
Priority date is August 2001.

It will "affect" you inasmuch that your 485 will NOT be adjudicated till your PD clears the cutoff.outletvolt1 said:

EAD/AP.
I am so darn frustrated now, that after lots of hassle I got my name check cleared from FBI on August 10th and now if my application is not cleared
before October 2005, I am screwed !! Arrrrrrrrrrrrrggg.

But then I think of the people who are in the following situation extremely screwed:
1. H1B has been used for like 5 or 6 years.
2. Priority date is 2001 or later.
3. EB3.
4. India, and China nationality.
5. Haven't submitted 485 yet.
Basically for this group of people, they have to forget about GC for good. Since they can not apply for EAD and their H1B will expire soon before they submit 485 (EAD) in order to keep them in status.
Am I right?

a) if they have Labor is pending, they can apply for 7th year extension.
b) people who have labor, but haven't applied for 485 yet, don't they
get 7th year extension similar to a) ?

You are extremely lucky that your I-140 has been approved and that your name check is cleared. There are many people with earlier PD than yours that are not even close to LC approval. So, just be patient and it will eventually happen.

here is what i think witht the retrogression....may ppl claim how their gc is pending for more than 6 yrs...see many of these cases are pending because of variety of reasons...
1. they joined a shady employer...who cannot provide proper evidence...financial support ..etc
2. the labor is screwed up...improper filing...resulting in RFEs...
3. ppl do not follow up when address change happend...RFE...not handled...
4. some of them i know did not even provide proper documentation...e.g filing EB-2 labor but did not provide previous employement certificate...i know of few cases myself...
5. the last and most important cause is you work for a greedy A$$ whole employer who just keeps pushing your case...as long as it can...so that he can milk your money...
in general...if you started the GC process 6 yrs ago..you should have had your gc by now..unless you are some exception. i personally am into my 5th yr of Gc processing...into my 7 yr extension....i blame myself for the current situation...not USCIS . i did get my EAD & AP so that is why i am not converned with the retrogression. i know i can change jobs if i want to and my spouse can work...that is the most important thing to me...i will be happy to get the GC at some point...if it does not come...i might pack my bags and leave...if it comes to worst..
i feel sorry for ppl who are close to filing 485 but who cannnot and have to wait..that is a problem. but i read in murthy.com that early next yr there might be some positive movement in the visa dates....so everyone hope for the best..
