Does RFE creates a back log in normal processing?

Hi All,
I am in the process of gathering all the documents for filing for family based green card through my USC wife.

I have almost all the papers mentioned in the various blogs and the forums. The only problem is with the medical certificate. As I have to undergo a surgery the doctors have recommended to not take any vaccines till the surgery has been performed. My question is that should I submit all the documents and wait for an RFE for the medical record or I shud wait till i get my medical record and then submit my case. Does RFE creates a back log in the normal processing of an application.

Any suggestions or comments will be quiet helpful.

Without the Medical information, your application wont go far. They usually scan for all the docs when they first get the application. So you may end getting an RFE quite early in the game. No harm in that, but I doubt if there is advantage to that either. So why not save yourself the headache and mail everything together.

Hi,

I did mail my applications without the Med Exam and got an RFE (see my time line). They will put your case on hold until they get what they needed from you. After I mailed my RFE,they responded pretty fast. It also depends on your DO if they'll respond quick to your RFE coz some people here in the forum got their cases delayed coz of an RFE.

Why not submit everything at once to avoid delays? :)
 
I haven't included a copy of my passport (with the last nonimmigrant visa obtained a few years ago) with my I-485 application form because per instructions it wasn't required.

Excerpt from the instructions for I-485, page 3:
Copy of passport page with nonimmigrant visa
If you have obtaned a nonimmigrant visa(s) from a U.S.
Embassy or consulate abroad within the last year, submit
a photocopy(ies) of the page(s) of your passport
containing the visa(s).

Also, I haven't included a copy of my I-94 with my I-765 application form because I applied for EAD as adjustment applicant under (c) (9) category. Per instructions of the form I-765, it wasn't required either.

Excerpt from the instructions for I-485, page 6:
A copy of Form I-94, Arrival-Departure Record (front and back),
if available. If you are filing Form I-765 under the (c) (9)
category, Form I-94 is not required.


Will I still potentially be facing RFE, if USCIS processing officer would like to see copies of my passport with the last nonimmigrant visa obtained a few years ago and the copy of my last I-94 form, in spite of the fact that instructions clearly did not require them?

Why would I need to start other thread? I thought my question is within the topic of the original poster. Or do I need a special permission to ask my questions in this thread? I wasn't asking for help either.

If you are not asking for help then what are you here for? I asked you nicely to start your own thread so other people may see it rather than hi jacking somebody elses thread.

If you dont wanna start your own thread then suit yourself.

The only reason I wanted to send it without the medical record is because I'll be bed ridden for 2 weeks after my surgery and if i want to send everything together it will delay the application by a month.

I might just send everything together.

sanename, get the med exam NOW and send in the application is my advice. If the docs recommend deferring vaccinations, then the civil surgeon can exempt you and it's all good. You can get the vaccinations afterwards and don't need to document that to USCIS. Since the civil surgeon is probably not familiar with your case bring some documentation or a letter from your surgeon or GP to indicate that the vaccinations are contraindicated.

I would not send the app without the examination.
