Does # of employees matter for GC processing?

My employer has olny 7 employees and 4 of them started GC processing. my question is, does the number of employees matter for GC approval? Will there be any risk in starting GC with that company? Only the advantage is that company is based in Delaware.

IMHO,

I don't think it does. I know there is a limitation on number of H1B-s a company can hold, but not on LC-s. In fact, I know a small company that applied for GC for almost all their emploees.
 
Reported revenue (to IRS) does matters. If company cannot show revenue then - sure shot rejection.

Also chance of getting NOF is less with larger companies as compared to smaller one.

With all due respect, I don't think this is quite right. As long as the company has more than 5 emploees, DOL views them basically the same (with caviar of having revenues).

I had intent to add the revenue aspect to ur reply and mine was not an isolated full reply in itself. Sorry for the goof-up - I should have mentioned it on the very onset.

The first para was for rejection and second for NOF. Thanks for your reply, makes point clearer for sure!

Frankly, this is just something couple laywers have told me. Number "5" should not be read literally. Better way to put it would be - "as long as company does not have a suspiciosly small number of emploees".

For example, software company claims to build and develop some major application (say: www.google.com) and it has only 4 emploees.

Hope this makes my point clearer.
 
Well, certainly having more than 100 employees helps since then all that is needed to show is ability to pay the offered wage is a letter from the CFO or other appropriate accounting official. For wmaller companies, BCIS wants tax returns or audited financial statements. Large companys have a much easier time showing ability to pay. Of course, a small company with a huge profitability will not encounter any major problems and a large company that is laying off thousands and showing $100 million a quarter in red ink may have extreme difficulties.
 
What are my chances ??

It is intresting to note how the size of the company and it's financial position matters, mine is very small company (software consulting) with only 3 employees, the company is paying me for last 3 years without any problems, will I have problems at I-140 stage due to size of the company ?
They do not have big revenues etc, but enough to pay my salary ($80K per annum)

I guess Jim mentioned ability to pay.

If there was no lay-offs - expect less problems.

However it may depend on who cooked food and cleaned dishes last night at certifying officer's home.

1. Sure you may know what NOF is. (You asked it - right?)
2. It is Notice Of Findings . (I think you wanted to ask it - implied one - right? - SEE THIS IS WHAT WILL HAPPEN IF YOU VISIT ANY LAWYER'S SITE SO OFTEN!!!)

In short it is akin to harassing a tax-payers legally to keep him/her bogged down.
