Happy Thanksgiving to everybody!
All right guys! here is the situation:
I have 2 friends that had been dating fro 6 years (college sweethearts) both from Russia. The came here to the US in 2007 on J1. Then extended their status to B2 and then trying to stay more applied for student visa through some kind of lawyer assistant who agreed to charge 75.00 for papers. She told them to gbet married that way one can apply and spouse can just stay with her. They did. It didn't work out, her visa was denied and they were told to leave the country during 30 days period. They did not.Since 2008 they stayed married and illegally. Well, last year she found somebody else and during few weeks filed for divorce(acting really nasty with her husband).Divorce was complete in summer. Now she is trying to get married with USC in March. And(she's really cheap on money but she's still my friend) she is going to the same assistant lawyer to file for her green card. That lady told her its not a problem and they have all the papers they need. My question: Is her process really that simple? Doesn't she need to deal with her removal/deportation(I'm not sure) first? is this lady just trying to get money from her? She does not want to listen to saying that I know nothing and she is competent in what she is doing. I'm just trying to help. Thank you. Would appreciate your opinions. Maybe its just me(really know nothing)

I think your friends new hubby matters here and he is a USC. I guess your friend should be ok and good on I-130 petition as a benificiery.
In the meantime, check that new hubby has no marital issues historically and did not involve with any previous spouse immigration petitions. I am saying that based on common sense and without knowing immigration technicalities.

If there is no outstanding deportation order against her, she should be fine. Yes the process is simple if you go about it the right way, the marriage is bonafide, and the couple prepares for the interview. Her marriage to the USC will be scrutinized like all marriages are scrutinized.

I would advice she get a different lawyer though or even prepare the paperwork herself if she is willing/ready to read about the process.

Thank you for the responses. Hopefully I am wrong but I have heard that if you are here illegally with deportation your marriage to USC is considered with red flags to immigration. Plus she's divorced and married during a year

Did her J1 have the 2-year home country residence requirement? If that is not waived she won't be able to stay for the green card.

advice

I think she should be fine but she need legal assistant. She should share all this information with a competent layer and should sue to the court. She could be success to get immigration as she is studying here from the last few years. And her certificates and skills might be helpful to get a work visa.
