DOES IT MEAN THAT MY NAmecheck is cleared ?

i finally got a reply to my letter about pending namecheck to President BUsh. it came from USCIS HQ in washingtoin DC.

does it mean that my name got cleared? i'm a bit confused.

this is the full text of the letter dated 20 april and reached my mail on 28 april.

does this letter means that my file is complete and now everything weill be done soon?

by the way, there are gramatical mistakes in the original letter, so i copied it as is. it was badly written.


Thank you for your letter dated February 17 2007 to the president George w bush. Your letter concerning the status of your i485 application and security checks was forwarded to department of homeland security (USCIS).

We have read your letter and understand that you are frustrated with the progress of your case. Based on the information you provided a search of our records, file A # (my alien number) has been completed. The information received shows that your application SRC-XXX (my case number) is still pending with Texas service center. We have been in contact with that office and have been advised that your case is actively under consideration with an officer at this time. Regrettably, as of this date a final decision as not yet been rendered.

The service is aware that your case has the processing time; unfortunately, sometimes adjudicating a case can become lengthy process. Upon gathering and assessing all available information, uscis will adjudicate your application as son as possible. We also understand the time sensitive nature of this matter and apologize for the inconvenience this delay may cause.

Uscis is committed to adjudicating immigration benefits in a timely manner while ensuring public safety and national security though the background checks for most applications or petitions are completed very quickly, a small percentage of cases have unresolved background check issues that temporarily delay adjudication of the application or petition. Although USCIS makes every effort to resolve such cases promptly, the agency cannot move forward until all outstanding issues have been resolved to our satisfaction. Unfortunately, the process can sometimes take years.

The background checks involve more than just the initial submission of biographical information or fingerprints and the initial response. If these checks and/ or reviews of the administrative record reveal an issue potentially impacting an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. This inquiry may include and additional interview and / or the need to contact another agency for updates or more comprehensive information. If it is determined that an outside agency possesses information relevant to the applicant’s background, Uscis asks that agency to share any relevant information for consideration by USCis in the adjudication. Upon gathering and assessing al available information, USCIS will adjuciatie the application as expeditiously as possible.

In checking the status of your case, we have been assured that the agency is monitoring the progress of this case and USCIS is reviewing the information received from the background checks, determining if any additional information need to be collected, and assessing if the information impacts the applicant’s eligibility for the benefit being sought.

We hope this information is helpful and your continued patience is appreciated.

this is why i'm asking , the letter is vague, too much jargon and confusing. can u tell me what makes u think that it is done and the case is ready?

well this is a wrongly written phrase, there is something missing before a search. i

1-t is either based on the infortmation you provided AND a search of our records, file A has been completed. in this case, it means that the file is complete.

2-but it can be as: based on the information you provided, a search of our records (file A) has been completed. in this case it means that the search records has been completed.

the difference between the 2 alternatives is that what has been completed, the file or the search? there is gramaticalmistake in the phrase that makes is weird.

... which seems to make a coherent flow to what follows thereafter.

Why don't you make an infopass appointment though. You will never be sure by asking here. Different people get different interpretations.

my understanding is that your NC is not cleared yet.

why u r saying that it looks that my namecheck is not cleared yet?

the second paragraph says that my case now will be reviewed soon by an officer, maybe an officer will not look at a case unless my name check is cleared.

also the last paragraph is hinting that my background checks are all done and now they are being reviewed.

i agree it is a vague letter.i'm going infopass monday.

BUt can u tell me how did u understood that my NC is not cleared yet?

the only hope that this letter give me is that my case has been lately assigned to an officer. maybe this means that it is complete. who knows!!!

They write, "USCIS is reviewing the information received from the background checks" - this means that NC has been finished, and your case has been sent to the USCIS for adjudication. I wish you all the best, and hope that information that FBI sent to the USCIS is correct, there are no records found, and everything is clear. Then they will make a final decision soon. By the way, have you done FOIPA request with FBI Records Management Department?
Also, I advise you to ask your local Congressman (or Congresswoman) to make an additional inquiry with USCIS about your case. If your NC has been completed, this will expedite your adjudication with USCIS. I did the same when started doubting whether my NC had been completed, and I believe that this helped to get the final decision surprisingly fast.

i have done FOIPA and sent it with my letter to president and first lady. thanks for your wishes. do you think that when they say that uscis is reviewing the received info from background checks (last paragraph), do they mean that they got them or it means when they will get them, they will review them?

the only thing that gives me hope fo this letter is that they are saying that my case has been assigned to an officer now(2nd paragraph). maybe this mean , that it is ready and complete to be processed.what do u think?

once i make sure that my namecheck is cleared, i will talk with my senator.

I got something like this written in the recent letter from Congresswoman: it was written that an officer was assigned for my case. I got this letter on April 30, but on May 2 got approval. So, stay positive. Do not torture yourself. I know how much energy this all takes away from people in such a situation. Just wait for a few days. And if nothing happens, contact your Senator.

I got something like this written in the recent letter from Congresswoman: it was written that an officer was assigned for my case. I got this letter on April 30, but on May 2 got approval. the problem of this letter is that it is saying things in a vague way. this makes u obliged to read between the lines tand o understand what it means. i believe that the letter is sayin in a way that uscis just recieved the FBI namecheck and USCIS wana analyse the content of namecheck in Washington DC then an officer in texas (where my case is) will pick up the info and make a decision about my case. do u think this is logical?
 
I understood that after FBI complete NC, they send the results to the USCIS Service Center (in your case is this TSC?), then it goes to EB’s Supervisory Adjudications Officers (SAO) within this Service Center, and they appoint an officer for final adjudication.

By the way, where did this letter come to you from? Directly from the White House? Or from DHS? There should be a signature on your letter.

Anyway, do not concentrate on this too much. Just wait, and your turn will definitely come!!!

I thought the first lady would forward your letter to FBI. Why did she forward it to USCIS? in the letter it says the department of homeland security (USCIS). Is the department of homeland security USCIS?

As far as I know, USCIS belongs to DHS. CIS Ombudsman is also a part of DHS, but independent of USCIS.
