If someone shows some business loss to get a little tax withhold, is it going to be problem for a H-1b worker during filing I-485? Does INS really check line by line to the 3 years Tax return form 1040? Any one had similar experiences, please post.

I am not sure how can you show business loss. I-485 is for Employment based immigration. You need to check with lawyer.

This is a fault of one crook tax accountant who showed $1000 business loss to get some tax return.

I know while on h1b you cant do any business. Now I am checking my old 1040 form and found this anomaly... any suggestion?

I think INS officers wouldn\'t really check. They would just want to know if you have filed your returns or not. Keep yr fingers crossed. You can always check with the lawyer ..after all (s)he is the one who is going to defend your case.

INS just wants to see if you have filed taxes...

and your W-2 forms....
Secondly, your accountant is liable for any false info. as he prepared the
tax documents.....

Fresh: so if I am not wrong, INS wont go inside the 1040 filing. Just they want to see whether I fil

actually you can run your own business

my wife is on h4 (EAD now), and we file jointly, and i do show her business expenses as a write off. it is perfectly legal as long as the intent to run a business successfully is genuine.

Call 1-800-829-1040 and ask

them for your last 2-3 years of tax transcripts. This is a free
service from IRS and get the short version of transcripts. These
will not show details other than the amount taxable and tax withheld,
owed or refunded etc....(this is to save you from unecessary stress)....

Submit this only if required...You can always get away by showing W-2....

Some RFEs ask for 3 year Tax return. Do you think tax transcripts are enough? Will INS request Tax return from IRS directly?

Forget about INS, it is safe to file revised return. It will show your honesty.

Mistakes may happen. You can rectify it, once it comes to your notice and it is safe for you. You need not sent a revised return to INS. In case any RFE comes, you can tell them about your revised return.

Good Luck
