Does inquiry letter really help?--- I-140(Eb1-OR) pending since Oct 2002

For unknown reasons, my I-140 (EB1-OR) has been pending since Oct, 2002. The current I-140 processing time Dec. 04, 2002. I filed I-485 in Dec 2003 (semi-concurrent). No fingerprint notice for I-485 and no updates for I-140 since Dec, 2003. Looks like my case has not been touched. Is it possible that my case is mixed up somewhere or lost?

The employer is going to send an inquiry letter. I am wondering if the letter really triggers or brings about any positive information about my case. Does VSC usually respond to inquiry letter in 30-days?

Can I contact local congressman to help investigate the case status at the same time, even though the inquiry letter is on the way?

Does anyone have similar cases ? Please advice what is the besy way to deal with this situation.

I think VSC does not continuously adjudicate EB1 cases. They do it for 10 days in a row - move EB1 line 2-3 months forward - followed by another 3 months of stagnation - no activity at all. As for OR category - they just moved processing date to Dec. 02 - meaning that cases with ND before that date were assigned to officers. We should expect another round of activity in OR category shortly. As for case status inquiries - they are so frequently left unanswered by VSC so I strongly dought their effectiveness.

Genemon, Thanks for your reply. If we don't have any action on the pending cases that have passed the processing time, these cases may be pending forever. Who knows how long it will takes?

I am running out of H1-B1 status soon. What should I do? Apply for a 7th-year H1B1 extension?
 
I would most certainly apply for H1b 7th year extension. It will cost your company some money but will bring more security to you and your family. Just check VSC processing time for H1B extensions (is it form I539 or still I129?). If you are getting close to the expiration date of your H1b 6th year - apply for extension. I heard that INS Notice receipt can give you a permission to continue to work. This way you can wait for your I140/I485 approval almost till the last moment before applying for H1B 7th year extension. But better play safe with timing.
