Does H1 Time includes OPT Time???

Hi,

I got my OPT (from Masters) on MAY-1999.
I USED OPT till JAN 2000 And Changed to H1B from 15-JAN-2000.
I moved to new company in OCT-2002 and the H1 and I-94 expiration shows MAY-2005. Does This mean that my Six year Limit started from MAY-99? I thought My H1-B 6 year Started on 15-JAN-2000 and finishes on 15-JAN-2006.

What should I do in either Case?

I already got my Labor approved on OCT-2003 and Filing For I-140 Now. Am I eligible for 7th year extension?


Please give me advise so that I can plan ahead.

Dude, in any case in 05/05 you will have finshed 365 days after filing labor. I estimate it will be over in Apr or May of this year (assuming you filed your labor 04/03).

You might not need 7th year, even if you do, U should be eligable.

I didn't get what you are saying. Could you please explain in detail. I dont know much about immigration issues and terminology.

Only after you received your H1 approval from USCIS, your meter of 6 years started.
And the same rules of H1 extension apply for you , bearing that your H1 started on 15-JAN-2000

You file your 140 now. It is approved by (say) Jan05. But on 06-Jun-04, 365 days since filing labor (and it's many other varients) woudl have passed. So in March-April 05 (depending on what route you take - 485 or CP) you can keep on getting yearly H1 extensions or be on EAD/AP status. Which should'nt be much of a problem for your status.
