Does H1 processing have any affect on K1 processing?

Hi Folks,

I am a US citizen and I have applied for K1-VISA (I-129 Finace) processing with CSC about a month ago.

My fiance is getting an opportunity to come to the US on H1.

Before she actually goes forward with H1 processing, I have the following questions.

1. Does H1 processing have any bearing on K1 processing?
2. Does K1 get cancelled automatically if she is granted H1 and comes legally on H1 VISA or do I need to write to CSC requesting for a cancellation?
3. When she is here, can we get married here and apply for GC/AP/EAD processing?
4. Do you guys see any technical or any other issues with such a situation (H1 processing while K1 is being reviewed/processed)?

I would greatly appreciate if you guys could help me answer these questions.

A2: I believe the consul will not cancel the K-1 visa if an H-1 is also issued.
A3: Yes. However make sure she spends at least 90 days on her H-1 status before she applies for AOS.
