Does Canadian green card impacts US green card?

We've just been informed that our Canadian green card is approved and are asked to mail out passport for canadian immigtation visa. Our I-485 were filed in Oct. 2002 and haven't got FP yet. My question is: Does it impact our US green card if we go landing Canada? Thanks for help in advance.

I landed in Canada and still have my application for US GC pending without FP notice yet. I got an advise from my attorney that it should not affect our US GC process. I do not know whether you should cancel the Canadian GC at the time you get US.

Technically, you cannot be permanent resident of two different countries at the same time. The definition of "PR" itself doesn't allow that. However if you are a citizen of one of these countries, you could have the PR of the other country at the same time.

Canada gives an immigrant upto 3 years to land. However having a Canada PR stamp on you Passport could be a problem, when you go for USA GC passport stamping (and vice versa).

Now it is your choice. I am sorry to say that you need to give up one of them.

Sounds like a polygamy in most countries where threesomes are not allowed. Sad. Dude, choose your favorite if you must make a choice.

Thank you very much for your reply, guys. It's really a tough decision. For sure the US PR is my first choice. What do I want to know is that if I go to Canada for landing, can I still come back to US without ant trouble. Can I use my AP to come back?

micaprasica, When you came back from your canadiam landing, do you use AP or non-immigration visa, such as H1? did they check your passport? did they say anytjing about your canadian immigration visa? Thanks

Technically, no.

Practically, well, it's like murder case, if you don't get caught, you are a free man.

The GCs in both countries are based on 'intent'. If you show your intent as not waiting to live there anymore, your status will be gone unless you can argue successfully in court. However, having PR status in both countries wouldn't help in court.

So, make your choice.

I returned to US on my H-1. On the border they asked for the letter from my emloyer and that was all. He looked at the passport, did not say anything, I do not know whether he saw the canadian visa or not. At that time I did not have anything in the passport showing that I applied for US GC. Anyway, I think that we have to choose when it comes to US GC stamp. I did Canadian PR because I wanted a kind of backup since I knew it woyld be a long process for US GC and you never know that it will end succesfully.
In regard to "intent" I personaly think that it only applies for your intention to stay on USA permanently ( applying foo GC) while holding for eg. F- visa.

I am not sure!

I do have a Canadian PR and I did show US consulate when I went for H-1. They were curious why I need a US visa for my H-1 since I have my Canadian PR. I told them that I need a US visa if I go out of US. I have to come through Canada to US and I didn't want to that.

You can have multiple PRs I believe and no one cares. I have seen a guy with Aus and Can PR working in US applied for US GC. If he doesn't stay in a PR issued country, it lapses anyway.

Hi All,

Just back from landing. Will post my experience later. I talked to lawyers and even called INS. It looks like there is no nagetive impact on your pending US GC.

Hi tscgc2004

just curious, how long did it take to get your canadian PR? I am thinking about applying for it. thanks

ours are the worst case I believe. It took us almost 4 years. A lot of my friends/coworkers needed only a year and half.
