I got a good job offer in USA (Detroit) but plan to live in Canada (nearby Detroit). I have Canadian PR and approved I-140 (EOA). Currently I'm on H-1B visa for 2 years. Should I:
(1) go ahead and submit I-485 and after I got green card take the job (if it still waits for me ). or
(2) go to Canada, take the job in Detroit, transfer my H1b visa to that place and drive every day to Detroit for 3 years - and after apply to Canadian citizenship and only then submit I-485 (I;m not sure if approved I-140 has any expiration period).
The reason I'm asking:
The rule for American green card says that I cannot be out of the USA for more the 180 days. Does anyone know what kind of rule is applied for the person who lives (spend nights in general) out of US but works for fulltime in US? If i apply and get my GC now will I loose the US green card in 6 month while live in Canada and work in US (in fact crossing the border 260 days a year)?
I know that for Canadian green card the nights are count and if someone left and returned to Canada same day - it counts like you have been in Canada.
I will appreciate any help form personal experience or someone who heard anything about this. If possible give a refeence where I can read about this. Thank you.
