Hey guys

I have a Q for all of you, esp ppl who have gone thru the GC process…...I first came to the US in 2002 thru an India-based company who filed for my H1B for a client project here……after working with them for about a year, I contacted a desi consultancy to get me a job here…….the recruiter there told me that I will have to “improve” my CV and added a few months to my actual work experience(+ 9 months), and also changed my project descriptions to suit the job availability- it basically ended up showing I had a few months more of Java experience than I actually had....i finally got a job with a different company who filed for my H1B transfer using that ‘improved’ CV (which btw was different from the original H1B CV)…

…now here is my Q: I am planning to file my GC thru my current employer and would like to use my real experience and CV (which wd be 9 months less than that shown in the CV used for my H1B transfer, plus some project details being different)……do any of u think there would be any comparison of CVs i.e between the one used for H1B transfer versus for the GC application?…pls remember that the CVs for the original H1B and H1B transfer were also different, but that did not seem to have caused any problem…..some of my friends tell me that the experience letters/CV etc are not checked in a lot of detail even for the GC -esp when it contains out-of-US experience as in my case and that I can use any and it wouldn’t matter much…..but I wanted to check with somebody here who knows these things well….I am aware that this is a less than ideal situation and wish I had not changed anything but at that time the recruiter said I had to do that for him to market me….and ever since then I have wished I hadn’t done it, and that’s why I dont want to use it now…..and I don’t think that improved my chances in any way apart from making me feel guilty since then

Thanks v much and I wd appreciate any of your responses

You should be OK...

USCIS does not match resumes from old petitions. They rely on education eval agencies and expereince letters for all their work. Don't worry too much about this and file you GC with real experience that you can prove.

In the Labor Certification process, in ETA750 form carefully write your "from" & "to" dates/year. It is safe to have matching experieince letters as mentioned in LC process.

hey guys!

...i've sent Private Mssages to you asking for clarifications about your replies.....i'd really appreciate it if you could PM me back or e-mail or post your replies here itself

..thanks for your trouble...

It is better to file GC with "real" experience. "Real" means that you have evidence to support. I remember at my I-140 stage, they asked for the letter to approve my work experience from previous employers, it has to come from HR if the company is still exist or from ex-manager/ex-colleague if the company is no longer exsit. Usually you get the real job description and the work period from HR. This is just for safe side. I really don't think this would be an issue. Since my letter had only a few sentences stated job title and start date (month/year) and finish date.

I got a RFE for asking copies of all the experience I had submitted in the resume for GC at 140 stage(each and every experience matching the dates).

So keep the evidence of all the experience somehow

RFE 10/19/2004 DOB for self. DOB and Proof of Relationship for spouse
RFE replied 11/05/2004. USCIS Recieved 11/08/2004 for self 11/09/2004 for spouse
LUD changed 11/09, 11/10, 11/12, 11/15.

will_get_there,

Does USCIS match old experience letters from old petitions ?

Usually not. But they will have access to those things. In some of the Administrative decisions they have referred to old H1s.

It is better to supply the proper resume and related work experience, which you can support.
