Does any one file Immigrant visa on your behalf?

the form that you fill in for H1 revalidation (Visa stamping), there is question saying 'Did you or any one on your behaf file an immigrant petition?'.

In my case, my company had filed for I-140.

1) So should i say Yes for that question?
2) If i say 'Yes', will i be in trouble as some one already filed for immigrant visa and i am trying to travel on Non Immigrant visa??

Please let me know

Answer truthfully. H visa is a dual intent visa, meaning it will not be denied solely because you have intent to immigrate. It will not be a problem.
