Does AC21 Portability affected by Priority Date Retrogression

I filed my I-140 and 485 in July 2004, My Priority Date is December 2003 under EB3 and The Priority Date Started retrogressing in Jan 2005. The Duration with Current Priority Date in my case is Less than 180 Days, but I accurred 10 months with out any Priority dates affect. Now, I am wondering is it OK to change the company using AC21 with Similar Job Profile. As I am getting lot of opportunities with same Job Profile and Better salary then now. Does the Priority date has any affect on AC21 accural of 180 Days. Please help me in this regards. Thanks.. Anil

According to the latest Yates Memorandum, priority date retrogression has no effect on your AC21 benefits - the fact that the dates have retrogressed will not affect you negatively at all.

It already is law. The memo is an interpretation of an existing law.
