Does a RFE cancel premium processing?

Hi,

I recently received a RFE for my H-1b transfer. My lawyer responded with the evidence the same day and I just checked my status online and saw this.

"On January 10, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done."

Why will it suddenly take 60 days? does the RFE mean the 15 day guarantee is now cancelled? :(

Thanks for any info!

For anyone else in this situation, I found out the message is a standard template, and as such doesnt reflect the PP filing.

yes. RFE is issued for questionable cases (many REF's lately) and the premium clock stops there. It is there somewhere on the uscis site.

Not exactly - premium processing guarantees a 15 calender day turnaround time whether the case is approved or an RFE is generated. The 15 day clock restarts upon rebutting the RFE.
