Documents that are to accompany N400 Application

I have been reading certain posts on this forum, I have seen it being mentioned that you are to attach a copy of your IRS transcripts for the past 5 years .
I read the N400 applications and the instructions for N400. I have not found attaching Tax transcripts any where.

1) Do we have to send in tax transcripts with N400 ?

2) If so how many years of past transcripts should be attached ?

3) where in the N400 or the Instructions does it even mention about tax transcripts ?


Please advise
 
You don't need to send them along with N400.

Have the transcripts for the past five years when you go for the interview. If the interviewer asks about your tax filings for the past five years, just show the transcripts.
You can get the transcripts by calling the IRS

1) No. You do not send tax transcripts but get them ready to bring them for interview in case they request it. It is extremely unlikely they need to see them unless your accplication is marirage based or you answer Yes to those
tax related questions or you have very long stay outside USA in the
past

02/20/2003 Became a permanent Resident (arrived in America).
05/24/2004 Left for native country (to continue with college).
02/27/2004 Arrived In America.
05/20/2004 Secured a Re-Entry Permit and Returned back to my native country to continue with my college.
02/02/2006 Arrived in America.
05/19/2007 Left America to native country.
11/08/2007 Returned to America
07/29/2008 Left to Native Country (got married to a citizen of my native country).
10/16/2008 Returned back to America.
03/03/2009 Left to Native Country.
05/13/2009 Returned to America

I had stayed outside the country

279 days on my first trip.
623 days on my second trip.
173 days on my third trip.
79 days on my fourth trip.
77 days on my 5th trip.

from 2003-04 to 2005-2006 I was a dependent (claimed as a dependent) on my dad and he had included myself in his tax returns. Its just since 2006-2007 and then on that i started filing my returns.


as due to my many trips i dont think its a good idea to include the past tax returns. what do u think?

as i was claimed as a dependent by my dad should i include his transcripts as will for the years 2003 to 2006 ? or is the past 4 years just fine?


please advise
 
You can send them with your N-400. Less crap to carry to the interview!:)

Maybe too much not really required stuff sent with N400 can mess up the process of initial review of N400 by NBC and delay your interview. So better not send in stuff which are really not required but only prepare them for interview in case (most likely you do not even need to bring them to inytervirw but juts do it in case).

You have some long trips. Though the longest one is only partly within the
last 5 years but still USCIS want to make sure you did not abandon your GC.
So for now you should consider the TAX transcripts as required documents
to be on the safe side. Better get tax transcripts for year 2004,2005, and 2006 or copies of returned. Also get some utility bills, bank accounts, etc
for these years. Don't worry if you do not have them but the likelihood
of USCIS wanting to see them increase to some extents. Still you do not need
to send in them with your N400 but prepare them for your interview

i was included in my dad's tax filing during 03-04, 04-05, 05-06. i did not have any bank accounts, utilities or anything for that time period. from 06 till date i have ban accounts and my own tax returns filed independently but i do not have any lease/utility bills, all i had is a car registered in my name and info that my car was insured under my name , that too from 2006 . is that enough or am i trouble ?

Don't worry too much. You should preferably get and try reasonable efforts to get all those documents as many as possible but if you find it very hard to get, don't lose sleep on it. USCIS IOs may not feel a need to request for them but again just make reasosnable amount of efforts to get these documents. For example, ask your daddy to get his tax transcripts for those years. Get your old car registration and insurance papers ready if you still have them.
Also try to get school transcripts, diploma from the college you attended in your native country. USCIS may accept attending school outside USA
to be temporary.

Another issue you have is that USCIS consider a long trip outside USA
wipe out the accumulated GC time towards citizenship eligibility and the 5 years
on GC should restart for filing N500. Your 623-day trip is from 05/20/2004 to 02/02/2006.
So find out when your new 5 year on GC should start - 05/20/2004 or 02/02/2006 or some
timepoint in the middle. Also check out the 4 year plus 1 day rule. If the clock is re-set at 02/02/2006,
you will be eligigble in 02/03/2011. If you can apply this 4 year +1 day rule, you will be eligble
02/03/2010. I don't know if 90 day advance apply to people who use 4 year +1 day rule or not.
If not, you can file N400 after 02/03/2010. if yes, then you can file N400 from now on.

I am not familair with this 4 year plus 1 day rule but I remember it is explained in M476 and M476 even
gave an exmaple similar to your case. Check it out first for yourself.

waiting for n-445

i have my interview december 17, 2009 i recieve n652 with congratulations recommend for approval and i passed civic test and english. its been four weeks now never got letter or n445 im not sure when m i supposed to recieve any idea. thanks

I can get my dad's tax return info, its actually with me, and i have mine too. as i was living with either dad or my sis and family i never had utility bills under my name or had rent, lease or any property :(. I can produce the car insurence information and the registration (for time period after 2006). and school transcripts that show that i graduated in 2006 january (Convocation date).I have inquired about the 4 year +1 day rule and I am confident that that rule applies to me, as i had GC issued in 2003 and had a Re-Entry permit (that makes me eligible for the 4 year +1 day rule, the only this is that i have to attach a cover letter with my N400 application), but the rule does not allow the people using that rule to apply in 90 days in advance. So i should wait for FEB 3rd 2010. In the mean time i will try to get the documents that you had mentioned above. Thanks again

But my attorney is saying he will show them supporting document during interview.He is not sendign any supporting document like marrige certificate, taxes, leases etc . Can you guys please suggest me should I send supporting document right now or should i send with application

Bring them to the interview. It does not seem the IOs review your files befire interview date. Your file is only initially interview at NBC who will send a yellow letter telling you what to bring to the interview.

Only send in basic 4 things: N400, copy of GC, two photos, and a check (I believe actually only N400 and a check are really required for USCIS to accept yoru case)
plus copies of documents that are really related to some questions you answer Yes that can affect your eligibility like copied of court record for charge/citation/arrest records.

Send only copies not originals. USCIS is not reposible if original is lost
