Documents for H1 and H4 Transfer

Hi All,

What are the documents required for H1 & H4 transfer?
Can some one pleaese provide a complete list.
Is it necessary to submit all the documents that I submitted at
the time of first H1 like resume, degrees, degree evaluations, experience letters etc?

Also do they file for a new LCA for H1 transfer?

What is the best time to resign from the old company, should I wait till the transfer to approve or should I resign as soon as the transfer papers are received by BCIS.

----------- Yes, submit all the above to your employer or lawyer with recent pay stubs and copy of current H1 approval notice and copy of valid I-94 (front and back) lawyer may also ask for copy of passport pages
For H4 of spouse submit her valid I-94 and passport pages along with Form I-539 you have to pay the $ 140 BCIS fees (ask the new employer if he is ready to pay that fees for your spouse H4 or you can pay) and it should be filed with your H1 transfer papers so that your spouse should also get H4 extended and newI-94 for both of you will have same date and H4 extension filed with primary applicant is approved at the same time

Also do they file for a new LCA for H1 transfer?
------- Yes, New employer needs to get new LCA for you and that will be attached with I-129, new employer can get new LCA in maximum5-6 days as it is fax back system
what is the best time to resign from the old company,
------- No need to resign, many don’t inform the past employer till the time they file for H1 transfer and get the receipt of H1 transfer from BCIS, you may have to collect you balance pay from past employer
Should I wait till the transfer to approve or should I resign as soon as the transfer papers are received by BCIS.
---- You can start working they day you get H1 transfer filing receipt from BCIS, many join they day package reaches BCIS and they confirm by FedEx tracking, to be sure that H1 transfer has been filed it is better to join when you get receipt notice that H1 transfer has been filed
