Does the lawyer specify the EB-2 or EB-3 category when filing for adjustment of status ? Or the INS just processes the i-485 based on the I140 approval category ?
I am asking this , because i read a couple of posting where people had the I140 approvals in EB2 , but when they spoke to the IIO, they were told that the INS was processing their I485 in EB-3 ? How does that happen?
Do you have to talk to the IIO to know the fact ?
