DO we need visa stamping again for new employer

Hi everyone,

I have H1b visa and my wife is on H4. I just got my H1 visa transferred to new employer (another I-797 , not the stamp on the passport).

But the visa stamps on our passports is valid till March 2008.

My questions is that, my wife needs to travel to home country. Is it possible for her to come back to US on old visa as her visa expires in 2008.

------------ if you have I-94 attached with H1 transfer approval then you can remain in US and can work till I-94 expiry date.

-----------------Yes, if you are on H1 status, Her H4 is tied to you not to employer A or B. you did not provide info about YOUR I-94 expiry date or your spouse I-94 expiry dates
*** she can show valid H4 visa stamp and YOUR H1 transfer approval notice at POE and will get I-94 till your H1 transfer notice

No you dont need a new stamp. As fas as she is carrying new H4 approval notice with her, she is good to travel on old (but valid) visa.

No need to do stamping again. I have done this in the past. The visa officer ask me why you have new I-797 so I said I changed company no more question after that. This is very common on H1-b and they already knows about it. The key with immigration at any place is to only answer the original question (no more no less) and always tell the truth. It always works. Good Luck

Just for clarification, What are the documents we should keep at POE. Would new 797 alone be fine or we should keep some other docs as well(W2, paystubs, bank statements etc.).

They don't generally ask for anything other than Passport, Visa and I-797s, but as a general rule I carry atleast one copy of EVERYTHING ABOUT me WITH me. Also a good idea for your wife to keep a copy of marriage certificate with her.

---send your new employer letter to your spouse and she should show ONLY if asked, valid H4 in passport +your H1 approval notice is enough.
