Do we need to submit the original parents marriage affidavit

When filing the I-485, I-130 package for Parents - I believe,based on reading, only copies of supporting documents need to be attached (exceptions are employment letter and medical check envelope).

However, an expert in another board said that the following two supporting docs should be ORIGINALS too. Just wonder what is your experience on this?

* Affidavits for Birth, Marriage etc., (if any)
* Tax Transcripts

I am particularly not sure about the affidavits. Should originals be mailed with the 485 package or are Copies alone enough ? (So, we may take the original affidavits to the interview, when called).

In my case, there is a difficulty in filing the parents’ marriage affidavit in originals since I am filing for my parents at the same time. --I only have one original copy of their marriage affidavit and it takes a long time if I ask my relative abroad to get another original copy.

The expert is totally wrong on this. Actually, the ONLY documents MUST BE original are-form I-864, I-693 (medical report in a sealed envelop) and of course pictures. Any other document could be a photocopy, including the affidavit about birth or marriage record.

Don't hear so much rumors. Plus, what happened in other people's case, doesn't mean it will happen in your case well.

When you are applying I-130, 485 you need 2 Marriage affidavits one each from your Dad's parent(s) and Mom's parent(s). These 2 marriage affidavits are for your Dad's I-130 only. If your grand parents are not alive, then you can get the Marriage affidavits - one each from one of your Mom's relative and Dad's relative as explained in this link.

You need to file Marriage affidavit only for your Father's application. So, your previous question of one Original Marriage affidavit for each parent's I-130 does not arise at all. B'cos for Mom the only proof they need is to have your Birth certificate show your Mom's name in it. No proof of marriage is needed to file your Mom's I-130.

So, in case you are worried about wanting to have another Original Marriage affidavit, then if you ever need it then it will be only at the time of your Dad's interview. So, you have plenty of time to get the other Original Marriage affidavit (it will be at least 4-6 months for your parents to get their interview), in case you mail the Original marriage affidavit with his I-130.

However, this is the first time for me to hear that we need grandparants' marriage certificate for the application. These are the 3 certificates I have found necessary for the application.

(1) The USC's birth certificate: The I-130 requires my birth certificate to establish the relationship with parents.

(2) Parents birth certificate: required for I-485

(3) parents' marriage certificate: Reuired in I-130. need to prove that they married before my birthday.

Can you elaborate the source of this information. I checked the link you provided but it was not explained.

Please read my previous post once again. I never said Grand Parent's marriage certificate is needed. What I said was, if your grand parents are alive, then get the Marriage affidavit of your parents attested by them. i.e. From your Mom's side, if any of your maternal grand parent is alive, then get one Marriage affidavit from them. Similarly, on your Dad's side if any of your paternal grand parent is alive, then get another Marriage affidavit from them. The Mar Aff should state your parents name, date and place of marriage, who they are son/ daughter of etc., All this is explained in the link earlier under the section "Marriage Certificate". I'm assuming you are from India. If not, go to this other link and look under your country's name.

Copy - Pasted below from the Marriage Certificate section for India:

If the marriage has not been officially registered, then two sworn affidavits giving the names, dates and places of birth of the bride and groom, and the date and place of marriage, as well as the names of the parents of both parties are acceptable. The affidavits must be executed by one of the parents of each party, or if the parents are deceased, by the nearest relative of each party who was present at the wedding.

Since your parents are already here, the option of registering the marriage now, does not work in your case. So, I believe that the Marriage affidavits is the only viable option at this time. Both the Marriage affidavits(one from your Mom's side and one from your Dad's side) are only needed for your Father's I-130. They are NOT needed for your Mom's I-130. If you read the instructions for I-130, you will know what to submit as proof for whom. I hope this clarifies your doubts.

Got your point. Thanks for clarification.

I am not from India and if my grandparents were still alive, they would be about 100 years old. I got a govenment issued marriage certificate.
