Do we need to mail the I94 to BCIS?

Sorry that my post is not related to 485 but I really need your information:

I applied for B2 visa extension for my parents in Apr 2003 (their visa expired at the end of April 2003). We didn't hear back from BCIS since then. My parents returned back to their home country in Oct 2003.

Last week, I got a letter from BCIS saying that their applications were denied and ask them to go back to their home country. Their original I94 are mailed back to me too.

My questions are:

1. Looks like BCIS doesn't know that my parents have left (although they handed in the copies of their I94 and the receipt notice of their applications for visa extension to the airline when they left), do I need to do anything to inform BCIS that my parents have left? Do I need to mail their I94 back to BCIS?

2. Since their applications are denied and their visa expired in 04/2003 but they left in 10/2003, are their stay from 05/2003 - 10/2003 considered illegal? If it is illegal, will they be able to come here again in the future?

You can write to BCIS, but it probably wont help anything as your parents have left already. Attach a copy of I-94 if u have one, but I highly doubt it would make any difference. But for your records do it, If later anyone question, you will have proof.

As per INS regulations YES. Because extn application was denied. As per rules , they cannot enter for 3 years if overstay / illegal stay is < 180 days.
