Hello,
I am planning to apply for I140/485. Didnt decide yet whether to apply concurrently or not. When i switched from my prev employer , he didnt
settle my dues till now( says i owe him some money) and didnt give me my experience certificate.

Can someone advise me , whether i need such a certificate and how should i go about it?

I am planning a visit to india in Oct( my prev employer is india based), i can take some action on this.
Thanks for your help,
Sri

It all depends on the catagory you are applying and your education level.

If you applying in EB3, then probably you don't need it. But if you are applying in EB2 and you don't have masters degree, then you need experience letters for 5 years before your current employer but not neccessarily from your previous employer.

I am talking from my knowledge. I may be wrong. Your lawer is your best guide on these matters.

suggestion

Collect all the experience certificates that you can collect. You never know when you will be asked for a particular document.

If your previous employer is not giving you a certificate, maybe you should threaten him with a lawyer ( assuming its in US)

Best of luck !
