Do we have to apply for H-1B extension?
Since H-1B extension costs a lot (1130 (INS H-1B) +140 (H-4)+ 800 (attorney'fee)), I wonder do we have to apply for this extension if we submited I485 almost 1 year already and job is also stable?

My boss think I do not need to do that (they do not want to pay),
and my attorney told me I'd better to do that.

Thanks

485486,

Can you post additional details? Like do you have your EAD? Do you plan to change jobs etc. It will throw more light on the situation, since some background on the process is required for a correct solution to be given.

But all things considered, as long as you have your EAD, then you might not need to extend your H1. Instead you and your dependent can work on EAD, go ahead and apply for AP though, in case you don't have it already, that way you can travel abroad just as if you had a H1.

Since you have already been in the 485 stage for over a year, you already fall under the AC21 law, and can change jobs at will.

AOS denied?

God forbid, If the AOS is denied and you don't apply for H1 extension, you got to leave immediately. that seems to be the logic from my lawyer to extend h1
