Do not have H1 petition documents

Hi,
When I quit my previous employer in 2006, he forcefully kept my H1 petition documents. I am currently in U.S. on a student visa. Is there any way I can get a copy of my H1 petition documents? I have the H1 visa stamp on my passport with the petition number on it(this visa was cancelled without prejudice when I applied for my F1 visa).

I believe that if I can get my petition documents, I will not be counted for a visa limit if I apply for a H1 in 2009 as long as I am applying for the remaining time period. I originally used only 2 & 1/4 years of my H1 visa. http://www.antaoandchuang.com/en/te.../you-were-previously-counted-under-h-1b-quota

Can I do a H1 transfer if my petition is still valid or should I apply for a new H1 visa and ask for the visa limit exemption.

Please advise.

Thank you very much.

Don't you have the copy of I-797 approval notice for the previous H-1B petition? How did you got that visa stamped on your passport?

HEy

I had the documents when I got the visa stamped. I quit the company 2 years after that and don't have the documents now.

Hi

I don't think that you can extend your H1 considering your last H1, specially when there is a break between your H1 Visa because of F1. Please talk with some lawyer.

Thanks!
