I hate to say this, because I really wish everybody well with their applications. But it needs to be said....

I am shocked at the number of people who write to this and other pages about RFEs referring to NYSDOT, who seem to have not heard of it before.

The question of NYSDOT and the third arm of the NIW is absolutely central in understanding how to successfully apply via this route.

Anybody who applies without DIRECTLY addressing NYSDOT in their original application has done themselves a great disservice. They have either hired a fourth-rate lawyer, or have failed to do their research in preparing their own application.

This is your greencard! If you don't have the ability to do enough research to at least know about NYSDOT, then stop taking chances with your life. Spend the money and hire a lawyer!!! Please!!!

It never explicitly address the question of time difference between LC and NIW process, which is often significant.

Suppose in the NYSDOT case, the petitioner argued that: 1) The NYSDOT needs the beneficiary's skill as soon as possible; 2) He can only start to work on these projects after he receives his GC.
Will this do the trick?

Hope someone, especially the experts in NYSDOT, can give some hint.

I made this point earlier. I think the reviewers have a checklist to follow. If all the points are not covered, then they have no choice but to send an RFE.
