Do I wait for H1b Receipt (case of h1 transfer)

I am with Company A on h1b. (I was on OPT previously, So dont have the stamp of h1b visa on my passport yet)

I have an offer with Company B and they are ready to file the transfer. They say, the fed-ex receipt saying that they have mailed stuff to INS is enough for me to start with them.

Is that correct & safe, or Do I wait till the formal receipt comes from INS to quit my current employer (whcih takes about 10 business days??)

When you start working with your new employer you will need to have and show proof of work authorization. In your case the only proof you can have is the ORIGINAL receipt notice form USCIS for H1 transfer, not a FedEx mailing receipt.

Thats what I told my would-be employer... but he says not "fed-ex" receipt is enough for me to start working for them..:( :confused:

I am not sure I understand what your mean by "but he says not "fed-ex" receipt is enough for me". Accepting only the fedex receipt as a proof of work authorization puts your employer in violation of I-9 (employment eligibility verification) requirements. If that is a risk both of you are willing to take, then go ahead.

My current employer terminated my employment because I had started working for a shady desi consulting company before I got the H-1B receipt notice notice.

Anyways if you want to take the risk, make sure that the company does not make any reference to it in a pay-stub. One of my friends started working for this company without a H-1B receipt notice but he made sure that the company did not pay him till he got the H-1B notice. After he got the H-1B receipt they paid him as bonus/reimbursement. I don't think it is worth taking the risk.
