Do I use N-400 to file for US Citizenship for my under 18 daughter?

Hi,

It's the time for myself, my wife and my 10 year old daughter to apply for citizenship.

My wife and filled out N-400 and now ready to fill out N-400 for my daughter, but it shows that you have to be 18 years old and above to use it.

Does my daughter have to file a different form? or does she even have to file at all?

I am sure this is probably anjswered else where, but I searched and I couldn't see it on the forum.

Your daughter will automatically become a US citizen once you or your wife (whoever first) become naturalised. After that you can apply for her passport and/or N-600.
 
List your daughter on your own N-400 in the section where it asks you to list your children. Then once you naturalize, your daughter will automatically become a US citizen and you can apply for her US passport and/or N-600 certificate (provided she has a green card and is living with you according to the conditions of the Child Citizenship Act).
 
Automatic US citizen

Once you and your wife become citizens, your daughter will automatically become one. All that you need to do is just file in N-600 to get a certificate of citizenship or go in for a US passport ( This is much cheaper ). I think you should just go in for a US passport.
 
I suggest that you get a passport FIRST and then file the N-600 (or do both at the same time but she'll get her passport first).

If she does not get a Certificate now the price will just go up and up.

Worse than that is that the DHS databases will still think she is a greencard holder. IF she ever gets in trouble, she would get stuck on an ICE detainer.

She will have difficulty being OK'd to work if run through E-Verify.

She will have difficulty getting a state DL or ID in a state that checks the USCIS' SAVE database.

She will have difficulty applying for student loans or grants if she is run through the USCIS' SAVE database.


She might have difficulty finding the required evidence to support an N-600 years into the future.


So, by all means, ignore the N-600 and see what happens.

Not yet attended to the interview.

1) what documents should it submit for kid citizenship @ interview time ?
2) should i present them @ interview time ?
3) They will some proof of citizenship status of kids after interview ?
4) should i ask about kids citinzenship and get some documents to kids citizenship ?
5) what documents should i need to apply passport for kids ?
6) I heard first parents should get citizenship, then kids automatically get citizenship (Just curiosity what is proof)?
7) First apply the Passport for kids and then apply for N-600 ? if there any documents for N-600?

Over-18 would file their own N-400 if neither parent became a USC before they turned 18. If at least one parent naturalized before their 18th birthday then other facts must be considered to determine whether N-400 or N-600 would be appropriate.

Bring your kids birth certificates to the interview. They might not ask for them, as they're probably already in your immigration file, but have the b.certs with you in case the interviewer asks for them.

When at least one parent gets US citizenship, their green-card holder children will also automatically get citizenship provided the conditions of the Child Citizenship Act are satisfied (under 18, having custody etc.). What is not automatic is obtaining documentary proof of the children's citizenship, in the form of a US passport and/or N-600.

The supporting documents for the N-600 are essentially the same* as for the kids' first-time US passports -- your naturalization certificate, birth certificate to prove the parental relationship, marriage certificate if both parents are still married to each other (otherwise legal custody documents would be required for separated/divorced parents), plus documents to show that the children are still living with the naturalized parent, such as school records showing the children having the same address as the naturalized parent(s).


*however, if the N-600 is obtained first, it can be used as supporting evidence of the derivative citizenship when applying for the passport instead of the long list of documents I just mentioned. But for practical reasons, most parents will obtain the children's US passport first because it is quicker and cheaper -- the passport is usually issued in less than a month whereas N-600 takes 2-6 months.

It's really not as big of a hassle as you are assuming. Kids don't have much beyond school and medical records. Got any correspondece from the school addressed to the "The Parents of: xxxx" or any joint insurance documents, Doctor's bills for the kid but sent to the parent, two pieces of documentation or mail for the parent and the kid, both at the same address? Is your kid listed as a dependent on taxes?

Yes, school report cards, medical documents etc. with both the child and parent's name, or at least the child's name and same address as the parent. Note that you only need those extra documents when applying for N-600 or passport. For your naturalization interview their birth certificates are sufficient (and they probably won't ask for their birth certificates at the interview if the certificates already in your file).
