do i qualify for eb1-ea ?

Hi Guys,

My employer has applied for EB-2 for me but due to retrogression, I am thinking about applying for EB1-EA. I'm not sure if I qualify though and would like your opinion in this matter.

I work as a Director of Information Technology in a large corporation with an above average salary (about 50% higher). I have 5 years of work experience and have authored two books and been a contributing author to two more. I have also written around 5-7 articles published in Computer Science journals. I have a Bachelors and Masters from a big ten university and have spoken at many conferences in the US and Asia. I can also get letters from professors and others in my field stating how my books etc. have helped them.

Do you guys thinks that is enough to qualify for EB1-EA?

It is very difficult to determine your chances, but you do seem to meet the minimum threshold for some attorneys to take your case. Many lawyers offer free consultations so you might try to find such a lawyer.

Since you seem to be in a hurry, does that mean you are planning to file an I-485 concurrently? If so, is your employer paying for it? If your employer pays for it but your EB-1 fails, will they still be willing to pay for another I-485 once your EB-2 priority date becomes current? Keep these matters in mind as you make your decision...

I will be paying for this EB1 myself, and will probably do premium processsing for the I-140 and if that is approved then go ahead with the I-485. I have spoken to one lawyer who said I might have a chance but was hoping to hear from you guys too before deciding to go ahead and spending the 5-10K.

If you read the rest of this forum, it appears that Premium Processing for EB-1 is proving to be a disaster, almost everybody is getting an RFE which delays the petition. From looking at those posts, it is almost certain that you will get an RFE, judging by the criteria you posted above and comparing it to other petitioners who have been receiving RFEs. Therefore, I'd have to say that your plan seems pretty risky to me, but wait to see what other have to say. Unless your current status will run out before your EB-2 priority date becomes current, I wouldn't even try to do premium processing (again, based on the posts on this forum).
