Please help gurus! Am I in trouble for AC21

Hello all!
I am in deep trouble here.
My I-140 is not approved and it was withdrawn by company in
< 6 months and now my company is sold to another.
I am not working for them now but got similar job class.
Already got denied notice for 140 and 485.
Please help if I can file reopen for this?

I am sorry to hear about your pb.

There is a case (painfull140) kind of similar to yours please have a look to this:

I am not an expert of AC21 but it looks like the conditions are:
1: more than 6month since I485 RD
2: I140 approved.
Now I am not sure if (1) is sufficient or if you trully need (1) AND (2).

Look check out the story of painful140 in the link above. He got approval in very harsh situation. I think that he had none of the two conditions.
Your case is however more complex since both I140 and I485 have been denied ...

Looks like the law at this point is not going 2 help me. I have to just give
a try by sending letter to USCIS for AC-21.
What happens to my EAD if I get 485 denial?
My wife is using for her work now.
Please help..

----if I-485 gets denied then EAD AP are also denied and are invalid for primary and for spouse.

I guess the above issues pertaining to AC-21 is not applicable to me.
Is that why there is no response from you. Please tell me your open
thoughts.. I know I am screwed up.

AFTER YOUR i-485 IS DENIED. YOU CANNOT WORK.. ITS ILLEGAL. iF you applyied for MTR ( motion to reopen) then its fine I guess. But in your case your employer withdrew I-140 before 180 days so there is no case. you need to talk to an immigration attorney asap

-- I got a H1B thru my friend now. But my wife stopped working as per attorney advice.

But in your case your employer withdrew I-140 before 180 days so there is no case. you need to talk to an immigration attorney asap.
-- I am talking now. But he seems to take advantage of situation and charging crazy $$. I am ok with paying as long as it can continue.
But if it is obvious closure, Is it worth a try for MTR?
Please advice me Gurus!!!

Hi,
This is painful140, i had the similar situation like yours except my 140/485 were pending at that time.
I think you should try MTR. Did your 140/485 get denied at the same time?
you may want to ask UN's opinions. He is a great person, very knowledgable.

Yes I got letter for 140 withdrawal and following week I got for
485 denied due to I140 withdrawal. The new company
which bought my GC employer said no immigration liablities
and will not spend any time and money.
Please advice gurus.. Is it worth for MTR?
