Do I need to extend H1 while I-140 was approved ?

Hi, Guys:

I currently filed I-140 and I-485 in April 2003, and I-140 was approved in August 2004. Due to Name Check delays in FBI, I-485 is still pending. I have 2nd EAD in hand. The company A which issued LC was acquired by another company B, and I am working in company B in same position as in LC.

My 6-year H1B visa will be expired in Feb 15, do I need to extend H1 ?

I appreciate your suggestions.

Generally speaking, Yes since it is a safety net. However since yor 140 is cleared, you have crossed the risk threshold in some way and now GC application is solely dependent on your job and your Lawyer ( if u got one) so one can argue that you should be OK using the EAD.

Thus, see how difficult it is for you to get H1 extension, if too difficult ( i.e company not supporting it) just forget it for sake of a good job. Atleast I would do so, so this is just my opinion.
