do i need to cancel CP?

Hi,

My 485 was approved on 1/20/05. My case details are below in my signature. This forum has been a source of tremendous help and I want to thank everyone who makes it possible.

I filed for my wife's 485 in 9/04. On a parallel track, she is a primary on her own CP application and currently we are waiting for our packet IV to arrive from Mumbai consulate. I was a derivative on that application as well.

The question we have is can she go alone for her CP interview in March (hoping) 05? Do I need to notify consulate/NVC/USCIS that I no longer will be going the CP route? or is it automatic?

Could people also respond with their comments/suggestions whether to abandon her CP application or not? And if so, how?

Here are my thoughts...
1) She has waited for almost 3 years to get up to this point in her CP journey. If we cancel the interview, everything is lost...is it possible to postpone the interview date and how?

2) She has not got her FP notice yet and also we did not submit her medicals yet for her 485. from the other forums, i can see that it takes anywhere from 1 month to 1 year to dependent 485 approved.

3) if we wait here and get her 485 approved, of course we dont have to make an immediate trip.

4) we may have to deal with the 'costs' of her CP application thru her employer. we dont know if they will charge us if we cancel the cp process now.

Go for CP

In my opinion (and experience), CP and 485 are two completely unrelated processes. We had our 485 pending when we went last month for our AC-140 CP interview to Delhi. They did not ask us even once about our 485 (becos CP is based on an approved 140 and has nothing to do with 485). Also, the same day we got our Immigrant Visa in Delhi, our Case Status on the INS website showed approval of the 485 also. So, obviously, approval of GC via CP does not have any negative bearing on your 485.

I would recommend that you should hold on to your CP process at any cost since it is guaranteed to be complete in a few months whereas the 485 process could drag on forever, especially since the ND is late 2004.
There is no need to inform the Embassy about any changes. When your wife appears for her CP interview and they ask about you, you can simply say that you've got your 485 approved and so you don't need to appear for the interview.

This is just an opinion, the final decision is yours.

i did add my spouse to my aos application in 9/04 when we realized she was not on there.
