I have a visa valid till 2007 (Company A). I now work for Company B. I will be visiting India in 2006 and will be getting married. Can my then wife apply for a H4 visa even though I dont have the current employer visa stamp on my passport?

Any help is really really appreciated.

This is tricky. Some time embassy requires letter from your current company to prove you are in their employment. Better you go and endorse your new company visa (but not mandatory) along with your spouse h4 if possible.

No. you don't require stamp in your passport when you already have unexpired one. Though you work for different company now, it's fine to travel on previous company's visa stamp. Only thing you would have to keep in mind is ; show new I-94 , notice of approval at POE while coming back to get I-94 valid until your new company B's h1.

When your wife goes for h4, she will have to carry copy of your passport, new I-797 along with other docs.

Thanks guys for the replies. My friends are giving me contradictory answers to this question. Some say I dont need a stamping, some say its better if I do. Can anyone who has actually gotten a H4 without a current employer stamping on the spouse's passport tell me if they encountered any issues?

My current employer is a small company and I dont want to jeopardize my visa by going for a visa stamping if its not required (since I already have a valid visa). What kinda questions can my spouse expect? Will she be quizzed on the company? Does she need to carry company related documents such as tax returns etc?

Thanks in advance for the replies.
