Do I need Revalidation of Visa ...Urgent

485 filed pending last 8 months. Working on h1, wife got EAD and working using that. She also got AP.

I-797 is valid till 2004. Visa on my passport is expired JUne 2002 and not revalidated.

Queation is

Trvelling outside the country in December. DO I need to go to Indian Consulate to get the new visa stamped on the passport. I do not have EAD and AP so far. wanted to return using h1.

After going through some of the threads, I got the feeling that one can re-enter the country without passport revalidation. One has to show the valid I-797 for the same. If it is true, what is the need of passport revalidation.

Please clarify... Any help would be appreciated.
 
This provision is for people who are busy and did not have time to get the new stamp. Also they wanted to reduce the processing load at the consulates. 99.9% of the H1s are automatic stamping kind. If you have time you should get the stamp and enter US.

Please clarify what is the definition of Busy people. I know i do not have time to stand in VISA line at Indian consulate since travelling at remote area. Also cannot affort to send my passport for three months at St louis for stamping due to all the uncertainity in job. Does this classify as busy. DO I need to provide such proof at the port of entry in USA.

Please also explain what you mean by 99.9 % automatic stamping. I did not get the meaning.

Automatic stamping- dont need interview, drop box variety. if documents are in order you can get the visa by post.
