My company lawyer says that I don\'t need to fill form I-134 for my wife\'s I-485. Some of my friends\' lawyers have asked them to get I-134. I am filing in EB2. Is I-134 required for wife in EB category for AOS ?
Yes absolutely. You need to file I134 (Affidavit of Support) for your wife (even if she is employed and not really dependent on you for living)and any other dependents you are filing 485 for. Infact I know people who received RFEs for failing to do so.
Ask your attorney to humour you and file it (even if he thinks it is not necessary) and save yourself an RFE.
