** Do I need H1 Visa *(change of company)*

I presently have H1 visa with company A which expires in 2005.
I am working for company B with valid I-797(H-1) but no new H1 stamping.
I want to go to India in September first week for 5 days.

1) Do I need H1 visa of the new company to enter USA? Can I enter using old company's H1 stamping(unexpired)?
2) My passport expires towards end of september(25th). If I renew my passport, can I enter usa with old companys H1 stamping from old passport? If I need stampng then is it better I dont renew my passport now?

Please help.

You dont require visa to come back to usa
Though you get the new passport .. Still you dont require a visa.
But carry both passports .

no you do not need the new stamp for rentry, just carry the new approval, employment letter and some pay stubs with you

--- it is better to get ur passport renewed, and carry both passports as the new I-94 will be issued only till passport expiry date in ur case Sep 25, you will have to file for extension after that. Better yet try and get the passport renewed from the home country consulate in USA and asve time in India.

Ok, if I renew my passport in US. I will have old and new passport. Old passport has unexpired H1 stamping from old company A. Can I visit India and enter USA with the old stamping(in old passport) eventhough I am working for new company B? I may not have enough time to get a new stamping from chennai consulate in the new passport.

Hi Did u encounter any problem in immigration while re-entering USA with the above issue. I am in the same boat now.
