Do I need Beneficiary Birth Certificate and passport to file I-130

My husband is being detained at Krome SPC in Miami Florida, and I live in NY, I want to file the I-130 but do not have a copy of his passport or Birth Cartificate. We have a lawyer who has done nothing and I cannot afford to pay another lawyer. How do I file this form on my own without his passport or birth certificate. Please help me.

Technically, those items are not required. You may have other concerns that you are overlooking.

Did you marry after he was served with his NTA or picked up by ICE the first time?

If yes, do you have "clear and convincing evidence" of your "bona fide marriage"? (Children's birth certs or current preganacy are THE ultimate proof.)

Do you have the ability to obtain his required signature on the G-325A and photos?
 
Are you a US citizen? Did he enter the US legally? If yes, what kind of visa did he use and how long has he overstayed?

Your answers to these questions will affect your options.
 
Also, why is he in detention in the first place? If he has criminal issues, it only gets more complex and restrictive.
