Do I need a Advance Parole if H1-B is still valid?

Hi,

My labor certification just got approved and I am planning to concurrently apply for I-140 and I-485. My H1-B is valid until 06/2004. I would like to know if I need to apply for a Advance Parole. My lawyer says that its my choice, I don't need to apply but I could apply.

Could someone please tell me if its better to have AP ? I plan on travelling out of the country sometime in Oct 2003.

You do not need AP as you have H1B visa stamped in your passport until 06/2004

apply for EAD if you want to change employer later or work part time on EAD and if You use EAD then you need AP, if you are not going to change employer after I-485 pending 180 days no need for AP but having EAD helps in future for getting a job immidiatly.

So if I apply for Advance Parole and decide not to use it, is it okay? Can I still travel on H1-B even though I have got an AP ??

YES
