i will finish my 6 years of h1 by september , i have applied concurrently for I140 and I485 in July ND is July 25, 2003, I140 got approved in July 2004 after RFE , no FP .
I appreciate any inputs , thanks in advance for your feedback.
If you want to keep continue working on H1 then you can file 7th year based on pending 485 Or you can even start working on EAD until your 485 gets approved.
In this situation (where the I-140 is pending), is there an advantage to filing 7th year extension over using the EAD? I can't seem to think of a situation where it would help....
My lawyers advice about maintining H1B until GC ap[proved was that if ever there was a denial the H1B would allow you to maintain more freedom during the appeal process. Freedom to come and go in particular to attend to urgent family business abroad for example. She cited one example where a parent death during such an appeal meant that a client of hers could not go to funeral as they could most likely be denied re-entry. For peace of mind she reccomends that you should always maintain H1B status until the !-485 is done. Not essential by the rules, but then there are always those pesky unforseen situations.
