Do I necessarily need to file for EAD I-765 for my kids?

Hi again,

Thank you so much for such nice website with very nice and helpful people. You guys helped clear out some doubts in my mind from my previous post.

Anyway to cut to the chase, my new doubt is if it is necessary for me to file EAD for my kids when I file their AOS? To give you a brief background, I'm a GC holder for 3 years married to a USC and just sent my application for N-400 last Tuesday. Somebody told me to just wait for my Naturalization to come out and by then when my kids get their GC they can just file for N-600 which makes them an instant USC. How true is it? If it is so, it will save me some bucks and time skipping the EAD process.

First of all, getting EAD is optional for anyone filing for AOS. You apply for it if you need to work. So, kids don't need it. :)
Have you ever applied for your kids' green cards? If they were under 18 when you got married to a US citizen, your husband could have applied for their green cards.
N-600 does not make someone a USC, it generates a citizenship certificate for a USC. If your kids are under 18 when you become a citizen, and have their green cards, then they automatically become US citizens: you can apply for their passports before filing the N-600.

starting on July 30, you kind of have to. Since AOS application fee will now be $1,010 and includes EAD and AP, even if you don't need them - you will get it anyway.

Are your kids under 18 and in the US? then your husband could apply for them now.

Thank you all for the very helpful information. I'll do my best to beat the July 30 fee hikes.

That's right!
Lucy, isn't there an exception for kids? It really doesn't make sense to get an EAD for a kid.
