Hello

I am on H1, but have EAD and AP. I have never used them.
I applied for renewal of both. I submitted those to CSC, but CSC has transferred them to local office.

1) Becuase of this delay and by the time local office gets to look at my EAD and AP renewal applications, my current ones will expire. Is that a problem?

2) Do I have to get my EAD and AP renewed before the current ones expire, even if have never used them before,?

3) When the local office gets to look at my transferred EAD and AP applications, what will be my receipt dates for those?
Will the dates be those established by CSC (CSC sent out receipt notices for both my EAD and AP) before they decided to transferred or the local office will generate its own
 (I know local office processing dates are different from CSC)

--thanks

There is no need to apply for AP/EAD if you are on H1. Only you can judge if it is wothwhile to spend few hundred dollars each year to have EAD/AP as backup for your H1 or if you are planning to change employers on EAD. In fact, effective renewal for EAD is ony 9-10 months as you have to apply before the previous one expires.

Hello Armie and All

Thanks for the reply.

Company does the renewing so not bothered about cost.

Also do I have to renewe EAD/AP without gaps even though I will be not using EAD and probably might use AP.

Please let me know

When we apply EAD renewal :

Do they add 1 year on the last expiration card ?

Or

Do they give you 1 year at the receipt date of the application ?

regards

They always issue EAD/AP for 1 year from the date of approval.
So, if you apply too early, you loose the balance on the previous EAD.
If you apply too late you are out of status. Either way you loose :(

About losing balance on previous EAD? It use to be that way, from my experience of applying my 4th one, the last 2 years they are not cutting of EAD Date, the new one starts when the old one finishes regardless of the time you applied to renew it. :)

Better to Have EAD AND AP then H-1

You should keep renewing your EAD and AP every year just incase something happens with your job. H-1 is tied to current employer, while EAD gives the flexiblity to find something else incase you lose your job or want to switch. Easier to travel with AP then H-1B.

khanhammad, what is the lucky service center? :)

My EAD was processed at TSC, and yes, they did cut off "the balance", making it start at the approval time, and not after the previous one expires :(

Mine is TCS also and I applied for renewal few months earlier. Mine got approved in August but it didn't cut off any dates. It started where it would've ended, September.

Stinger,

Since you're in H1, try to keep it that way as long as you have limits, but since the company is paying, apply for EAD renewal approximately 90 days before it expires. Since you're date is not going to make it but you never used EAD, apply anyway. Even if in the worst case it gets denied, there won't be any interference with your status and you can re apply, it will get approved.

starting date of EAD

Starting date of renewed EAD depends on the place where it is processed.
Some gove you starting date from approval (1 year), some after expiration of old EAD.
We applied in VSC, always 3.5 to 4 months in advance, first 2-3 times we got cut 3 months (approval came in 2 weeks), so we kind of renewed it once every 8 months, not every year.... and last time it was transferred to local center (Baltimore) and we lost only 2 weeks because date was still from approval but approval took longer.
Now I am in TX and my colleague here says they (TSC) do not cut the time and give approval from expiration of the old EAD.
Note: if you have a gap in EAD, you are NOT out of the status, you just cannot work...
