Do I have to file I-485A and pay $1000 if overstayed 8 days?

I am an F1 student. My I-20 expires in May 31, 2011. I got married to my US citizen wife on April 11, 2011.

I prepaired all the paperwork except the medical report I-693 because the civil sergeon is on Vacation until June 7th, 2011, which means I will file my paperwork approximately on June 8th, 2011.

Do I have to file I-485A and pay $1000 in fine because I overstayed on my student visa for 8 days?

I searched many other sergons in my area but no one is available before May 31, 2011.

When was your last day of classes before graduation? Don't you know that you have a 60-day grace period after that?

Anyway, I-485A and $1000 is not applicable to people who entered legally with a visa and are filing based on marriage to a USC.

You should also be aware that you'll need two appointments with the civil surgeon; the second one is a few days later to check the results of the skin test. Then after that, you still have to wait for the doctor to mail you the I-693 in a double-sealed envelope (the outer envelope will have your name and address and you can open it, but the inner one must remain sealed when submitting to USCIS). As a result of all of that, you won't have the documents ready to send until it's about 10-15 days after your first appointment. So June 20something is a more realistic date for when you'll have everything, not June 8.

No. You are not eligible for 245i relief, nor do you need it. As a spouse of a US citizen your overstay is automatically forgiven.
