Hi,

I am expecting my labor to be approved in MAR'05. i will be applying I140/485 in EB-3 but priority date won't be CURRENT' after 1/1/05. so i have to wait for priority dates.

I am an indian and my wife is a British citizen. somebody told me (even he confirmed this from sheela murthy) that since priority date is current for UK citizen, i can file the I-485 based on my wife because it will be filed together for both of us.

but I am not very sure about this. if somebody have any idea please let me know.

or please me point to somewhere i can find some detailed information about filling I-485 and priority dates.

If ur wife is sponsored by her company, she can file for herself and u. She will be a primary applicant. Priority date will be current if she is sponsored by her company for u and ur wife.

Or if u upgrade ur category to eb2 by getting master program. I think.

Otherwise, I am sorry. it took me 3 years to get my gc long time ago so did many people. U can try to file and wait for priority date to be current.

---ONLY if your wife is the Primary applicant and if LC is approved for her

----- if you are primary and she is dependent then you have to wait for PD as you were born in India

Just a thought, Can you get british citizenship on the basis of your marriage and then apply for I-485 as British Citizen?

If she is sponsored by a company in USA for green card and she is a British citizen, priority date will be current if her Labor certificate is approved because of her country of birth's limits, and company will file 140/485 for you and your husband.

She or your husband cannot file as British citizen/Indian citizen based on marriage instead of employment because you or your husband are not US citizens neither US permanent residents. It would be best for your wife to look for a job so her company can sponsor you and your wife.
