I was engaged to a Venezuelan man who came here on a tourist visa, but was at that time here too long. I am a US citizen. We had some problems and he got married several months later to a woman that he knew from Venezuela, who has legal residency status here. She filed his paperwork to petition for legal residency. Since that time he has become very unhappy in the marriage, and is wanting to be with me again. He has not yet been called for his interview. Can he divorce her and marry me? If so, does he have to start the whole process again?
