Divorce Question Please help

Here is the problem for which I would appreciate any help.
I have a employer based GC, my soon to be X has her
I140 and is waiting for her I485.
I have filed for a divorce in the US. But she insists she wants
the green card no matter what, and I cant partner myself in that.
So my question to the forum is,
1 ) If I withdraw the affidavit of Support, will her GC be revoked because
I heard that they(INS) might or might not care about the divorce.

2 ) is there any other way that I could see that she does not live in this country
( I am willing to give her whatever money the court asks me to but I dont
want to see her live here in the US as she can make my life difficult)

Any help would help.
thanks

1) Send mail to USCIS with the divorce paper from court to explain the situation and tell them her I485 is invalid.

2) If she has other status like H1 or B2, you can not kick her out of the US. Of course, she can still stay illegal in the US as long as she can (You can still report that if you want :) If she is working, report to her employers.

you are saying that she has her 140 and waiting for 485

check your statements, than she is on her own GC

Please clarify this point
If a person already has a 140 derivative through my GC then are they on their own in the
I485 state ?

there is no such thing 140 derivative, it is only 485 derivative

I assume you are the primary applicant and your wife is pursuing 485 as your dependent.
1) Withdrawing affidavit of support will most certainly revoke her GC process.
2) You can do this by revoking her process and (as suggested few posts above) informing USCIS where she is staying.

Your questions aside, I would not recommend going for #2 above. Understood divorce is a result of a not-so-pleasant relationship, but why cant you guys just walk off from relationship and move on, rather than thinking about how to harm each other. The thoughts/energies can be spent on better/constructive work (maybe finding a better life-partner). Anyway - it's your life & ur decision.

yes my friend, I dont want to be harming anyone.
Divorce is a very unpleasant thing to go through, I wish their was a way out.
again the reason why I thought about option B is best not discussed over a forum.

But I totally agree with what you have said.
Peace

If she is on 140 through then you can't do anything since she is being suppoted by the employer , so you can do anything since you are filling for her.
