Divorce in INDIA after Green Card

We got our GREEN CARD almost two years back (August 15th 2008). This is employer based and I sponsored my wife and daughter.

But...!!! Nothing is looking good in our marraige life. Some way our marriage is not going to last long. Recently we visited India , I came here alone and both my wife and daughter are staying there in INDIA. Here is what need some suggestions from you. Please help me on this...!

1. My wife lost her green card and now claming that I took that. She is telling she will complain to American Embassy in INDIA and make me arrest here for the same. Is this a problem to me ?

2. I don’t want to live with her and filed a divorce there in INDIA. Is there any way, I can stop her coming here.


3. My daughter is with her and I will fight for her custody in India, if I win, I would like to bring her back to usa. But problem is , I donot know how long it will take? She is also on green card. How can I retain her status?


4. How many months, my daughter can stay in INDIA without losing her GC status. Is there any way to keep her status intact.

A1: The US embassy will not be bothered with her complaint, assuming she can actually get a chance to complain to them :)
A2: Divorce her and move on. Why are you bothered about ensuring she cannot return to the US?
A3/A4: As a minor, your daughter will not be held responsible for abandoning her PR status. An adult will be responsible if she does not return to the US in six months. Now if she is the subject of a custody battle, she will most likely be able to regain her PR status upon return. If this divorce and custody battle is documented properly, an immigration judge will side with her. I am assuming the custody battle awards you sole custody of her.
