Divorce before Removal of Conditional Status

Hello all,

I received my greencard back in Feb. 2007 and have been married since April of 2006 (A little more than 2 years now).

Unfortunately things have been awful and one thing leads to another where we are getting a divorce due to irreconcilable differences. Can anyone tell me what his/her experience has been filing for a removal of conditional status on their greencard with a waiver of joint petition. ?

We dated three years before getting married, and I have alot of proof that we lived together and all during our marriage. I was a H1 holder before getting my greencard and under F1 status before that. I decided I will use a lawyer just to play safe.

Can anyone please give me advice on this process, timeline and all? I would really appreciate and take this advice from me, divorce is not a good thing to your spirit. As much as possible, try and make sure you can tolerate the person you are marrying.

If the marriage was bonafide, you should not have an issue with removing your conditions. As soon as the divorce is finalised, submit an I-751.
 
Submit the I-751 no later than 90 days to the expiration of your conditional GC regardless of whether your divorce has been finalized. That means, if your divorce is not final by the 90 days preceeding the expiration of your conditional GC, file Form I-751.
 
hey buddy,i was in the same boat as you but i go the condition removed successfully without any problem,no rfe, no inteview and it took about 6 moths,all u have to do is provide uscis with anything that will make sense to even a 10 year old that ur marriage was bonafide,i sent them alot of proof and they approve my case like is nothing,good luck

Hello Everyone,
I was wondering if someone can help me with a difficult position that I am in. My sister got married in Chicago
a month ago and came here on K1-Fiance visa. Her visa will expire on september 10, 2008. Her husband has not filed an adjustment of status
yet. Her mother in law is very abusive and she had made her life very difficult. She does not let her go outside, she constantly
mentally abuse her, yells, screams at her and ask for gifts and money, etc. Her husband does not do that but he cannot say no to her
mom and ignores all this. I was wondering if someone can tell me in this case if she can file for a divorce now or can she extend her
stay in United States and apply for a green card. Please let me know if there any possible ways to address this issue.

K-1 status holders can only AOS based on marriage to the sponsor of the K-1 visa.

thats great, congrats, though im suprised that you did not get called for an interview. from what i know, mostly all i-751 (divorce) cases get called for an interview, thats what Im waiting for right now. I will update all once i go through my interview (and if u dont hear from me it means bad news :eek:;)
